TOS can be easily disputed if you sue the company anyway, but yeah it's pretty illegal to have someone agree to a contract and then change it without telling them. Obviously doesn't apply to people who aren't dumb enough to keep paying for their shit.

Brohoster also reserves the right to change these Terms of Service at any given time, with or without notification. In the case of a terms of service change, if current clients do not agree to the new Terms of Service, their service will be terminated.
You have the service, you agreed to this part of it right here. It says that they can change it whenever and they're not required to tell you. Granted, it is good business practice to tell your customers if/when you change your TOS, based on this contract, they're not legally bound to. [editline]1636[/editline] I hate playing devil's advocate here, but it's true.
I requested a cancellation for my services (Web hosting) and it still shows as active on the WCHMS. I tried to cancel again and got a message saying I already tried to cancel (which I did). I checked my emails and found this
Dear *censored* This email is to confirm that we have received your cancellation request for the service listed below. Product/Service: Personal Domain: lazypenguin.org If you requested immediate cancellation then the service will be terminated within the next 24 hours. If however you chose end of billing cycle, it will not be cancelled until 10/04/2011. Thank you for using Brohoster, LLC and we hope to see you again in the future.
Hmm according to the WHCMS I'm due for billing on 10/04/2011.... I'm not looking forward to getting charged and then having to contest it -.- Too bad there's no way for me to prove that I actually requested immediate cancellation over a week ago...god damn it, do I really have to start frapsing my every move?
Then how can the current clients agree to the new ToS if they are not notified.
Be proactive and have an IQ over 5. I check the TOS of everything I play/use periodically so that I know if any changes were made and I can decide whether to continue on with my day or cancel service. [editline]22nd June 2011[/editline] And it is a legally binding contract, so you're kinda shit outta luck. [editline]22nd June 2011[/editline] And, if you look at most TOS, it's in pretty much every single one. This is so that if someone decides to be stupid and try and sue them for changing the TOS, they can say "We didn't have to tell you." and she the judge the contract the user agreed to.

Very bad business practice.), and it will be illegal for them to change the contract without you knowing. But reading that TOS personally, there is nothing he can do. Except kill Matt of course. Just tons of people prefer to just agree to any contract thats infront of their face without reading it.

You have a email and you need to save it. If they do bill you again, dispute it. You canceled it and they just cant ignore it. I suggest getting your EPP code now (or try) and start researching new hosts.

But I use my head and go back and look at what I agreed to. And yeah, the box was a little overboard. No hard feelings?
LazyPenguin you should transfer to Lithium Hosting. Good shit there.

I would like to add that Matt did send me a PM on the forums regarding this situation after I posted it.
As an FYI, You didn't file immediate cancellation: You filed for cancellation at the end of your billing period. Your billing won't be renewed, and that's why it shows as active still.
I'm quite sure I filed for immediate cancellation, but alas it is what it is. I'd like to add that the image of 'evil money grabbers' isn't quite accurate. My EPP code was sent to me on a timely manner and I guess my situation was more based on my ignorance rather than the 'evilness' of brohosters. Interestingly enough I cancelled my services due to the incredibly slow ticket response and not due to any of this drama.
read this everyday http://us.playstation.com/support/useragreements/termsserviceagreemt/ yeah....no
That's not that long, really. [editline]22nd June 2011[/editline] Might i add that you should try lithium hosting?

I dont think he realizes that if ICANN gets involved, it will not end well for him. There are few things that ICANN will not pass. This is one of them.
This is my first post, but I had to sign up because I was absolutely sick of the slander and lies Matt was telling in WHT. Could Jacob or someone else who is more into it sign up to WHT and set the facts straight? http://www.webhostingtalk.com/showthread.php?t=1058880
My first post here. Spent literally hours on reading everything though. The truth is out there, with both parties (Jacob and Matt) telling a part of it, and over exaggerating/making up additional remarks.
How good are your php skills?
Mine are okay I suppose, guess I could show you an example if interested. Does Jacob even need additional PHP scripters?
so brohosters facebook page just posted about craftbukkit and what builds they wanted so you get three of us like hey what about the press release so this AM dude is like patience is a virtue I played it cool like thanks for the info but inside I was like You suck. I think my comment that said this..... Can we get our press release first ( this is my polite way of asking matt should know what I mean ). Was fairly clever [editline]22nd June 2011[/editline] My friend dabbles in PHP he wants to know what he can do. He mainly does animation and cartoons so he might be able to do some animations for you if that helps but like I said he does know PHP a little bit. [editline]22nd June 2011[/editline] ITS OUT PRESS RELEASE IS OUT http://www.clubuptime.com/pressrelease.pdf
Press release is up and its a tab bit late but o well :P
http://www.clubuptime.com/pressrelease.pdf here it is [editline]22nd June 2011[/editline] I made Larry mad haha I guess I was flaming when I wasnt trying to haha
Less than 1%? Less than 40 people left, that's surprising
I think slightly more have left like closer to 100-200 but not more I know they are under 400 now
I'm not buying it :colbert: I have a great distrust of Club Uptime in general now thanks to Matt and his dumbfuckery. A press release can lie. Which wouldn't surprise me.
lmao that press release is full of shit trying to save their last remnants of a good face once JWJ has his new stuff set up i'm cancelling the fuck out of my service and hookin' up with the real bro anyway
this doesn't really answer the question, imho [editline]22nd June 2011[/editline] how was it not stolen?
