Problem is disk 1 seems to be fucked. SO. What is the legality if I torrent the first disk (disk 2 seems to be fine) and use my key with that?

As long as the discs are still in your possession, even if unusable, you have the right to download a backup
It is illegal to download it after buying it only if it's no longer in your possession (you sold it, gifted it, or trashed it)
