That's what I thought. If you're making those kinds of arguments you shouldn't be in a court.
Garland seems like a good choice, but sadly he won't make it. The Republicans are waiting for Obama to leave office.
I don't know if this guy is a moderate or not, but it's in the best interest of the GOP to accept whichever most moderate nominee they can get because otherwise come 2017 Hillary and the Democratic Senate will be making that decision and they won't like it.

Would be really chill if they compromised on, like, a libertarian getting up there. Doubt the fascists of the Republican/Democrat parties'll ever let it happen, though.

Or more likely because they don't think that the constitution has anything in it which protects gay marriage as a right. I actually agree, because to see it you have to twist words, even though I very much would like gay marriage to be legal. This is in fact why I favour having an uncodified constitution like in the UK.
