If movies have taught me anything its never bring a knife to a gun fight, or in this case never use your fist in an alleged fist fight that will actually turn out to be a gun fight.

People who say things like this, in my opinion, aren't responsible enough to carry a weapon for self defense.
You don't try to scare off an imminent threat to your life. You shoot, fight, run, or do whatever, in your best judgment, will keep you alive. You don't have time to think about the ethical or legal implications of it. You do it because it's going to save your life. No, it's certainly not pretty and you shouldn't feel good about doing it, but you're still alive.

The real problem is people lack the ability to empathize effectively, i.e. "I would have shot once to scare them!"
In a situation like that, you don't get time to think deeply, your adrenaline starts pumping and you start acting reflexively. In hindsight, some actions may seem over the top or ridiculous, like firing 8 times, but it's not like he planned to expend half a magazine into some kid, he simply feared for his life and defended it in what was a strenuous situation.

When you're in a defensive firearm situation, always shoot to kill. ALWAYS.
If you try to shoot a guy in the leg, you'll miss. If you hit, he'll survive and sue you, or worse, continue to attack you. If you fire in the air or into the ground, he might pull out a weapon of his own and either way you'll get charged with negligent discharge of a firearm.
If you aim for center mass and fire several times, you will have the greatest likelihood of disabling your attacker and saving your life. It's just mathematics. If my life is on the line, I'm not going to take chances to try and save a random thug who decided to assault me unprovoked.
All the stories you hear of people having their guns turned against them - those were people who didn't pull the trigger when they should've.

So, he shot 8 times out of fear? I could see that. Given that he should've kept a cool head, he felt a very present and powerful threat and assumed an armed attacker. The ruling is logical and good.

the jogger's retaliation is disgusting, i can't believe that shit is tolerated. panic or no panic, a punch does not justify being shot, let alone shot and killed. the jogger should face murder charges, not even just manslaughter.
