In a torrent network the distributor is considered the original creator of the torrent, not the subsequent peers. This is further cemented by the additional charges of copyright forgery involved in creating a pirate torrent.
What if the service (tracker) refuses to give up client information? It would be insanely difficult to find the original distributer, since he could have already stopped seeding.

If a torrent service actively moderates their shit and makes a concerted effort to even just look legitimate, getting a warrant is very difficult. That is why they prosecute so heavily on the people they [i]do[/i] find. It is so difficult and takes so many resources to track distributors down that finding the thousands that are active is completely impractical. Instead they use deterrence tactics, saying "You probably won't get caught, but this is what happens when you do." And in reality, we're talking about government here, not this RIAA bullshit that people think is the government. If a national government wants to find somebody, they will find them. ISP's are where these guys typically get caught. They don't [i]want[/i] their networks being used illigetimately, they will hand information over fairly easily. Organizations like the RIAA are private companies that take people to civil court, and the limitations that come with a criminal charge also apply to that charge's civil equivalent. Civil court has its own standard of evidence, which is why these cases are fraught with false accusations.
