Using legality as an argument for legalization/prohibition is inherently flawed.
You seem like your only argument for banning cigarettes is that law should be uniform, but using law as grounds to base law is stupid. That's like saying assault should carry the same sentence as murder because it should be all or nothing, which is wrong: we don't live in a binary world.

We do use other judgements when considering similar cases: it's called precedent.

Because it should come down to who owns the property you are smoking on/in. I can see public property being smoke free but if you come into my house or business and I want to smoke it should be my rights, it should also be my rights to disallow smoking in my house or business.
