He pulled over to make a phone call. If he drove into the guy's back yard, I could see why he'd be frightened.

If you take anything away from this conversation let it be this: Just because you feel threatened does not mean you are being threatened and does not give you legal grounds to execute somebody. When you draw your weapon on another man and kill him it's because you will die if you don't. No exceptions.

Being straddled as someone slams your head into the concrete would be seen as deadly to most reasonable people.
