I'm not familiar with XBL since I think it is stupid.
There is one huge flaw in the ban system for xbox live. When I was still living with my brother/parents I saw my brother and a bunch of his buddies on xbox live get someone banned by having 10+ people all file racism complaints against the person at the same time, then a few days later he came on with a new account saying he had gotten banned.
Any idiot can fuck you over on Xbox Live.

There have been so many ultra cheap Xbox 360 sales going on near me recently, I wouldn't be surprised if no one cared too much about being banned because the damn consoles barely cost more than the overpriced games you play on them sometimes.
I guess it's almost time to release a new console then, eh? Can't have prices getting too low now.
It's a bullshit lawsuit.
You buy an Xbox 360. You plug it in. You go through the setup screens, then create an Xbox Live account, which binds you to Microsoft's EULA, which specifically states that you are not allowed to mod the console. You mod the console anyway. You get banned for violating the EULA.
Because the End User License Agreement is a valid legal contract, upon pressing the "I Accept" button, you have entered a legally binded contract between yourself and Microsoft, with access to the Xbox Live offered to the end user as consideration. Said EULA specifically states that you are not allowed to mod the console. If you mod the console, you have violated the contract, and, therefore, it is now void, which means Microsoft is obligated to repossess the consideration because said contract is no longer valid.
Simple, logical, legal. Lawsuits like this simply clog the American legal system.
