[TD]A CANCER group which fought against the patenting of a human gene linked to breast and ovarian cancer has lost its landmark case in the Federal Court.
Cancer Voices Australia brought the case as it believed Myriad Genetics Inc, which owns the patent on the genes BRCA1 and BRCA2 linked to breast and ovarian cancer had an unfair monopoly on a naturally occurring gene.
It’s the first time the validity of genetic patents has been tested in an Australian court.
Cancer Voices sought to void the genetic patenting on the basis they were natural "discoveries".
Justice John Nicholas handed down his judgment this morning and explained the two genes, isolated from their natural cells in which they were found, constituted a "manner of manufacture" and could therefore be patented.[/TD]

This is beyond stupid, and beautifully summarises everything that's wrong current patent protection laws.
A company has legally acquired and retained the rights to something that belongs to, and is owned by every living human on Earth, in the name of "innovation".

It shouldn't even be possible to patent genes.

Well, he's flat out wrong. If I go and pick a flower from a field, have I manufactured one? I've not, I've just picked it and isolated it. If I was to find a new species of animal, stick one in a box, do I suddenly own that entire species? No, I don't.
Fuck this kind of logic, it's a disease to our species.
Isn't that like patenting say, a crystal formation?

And with the way Monsanto and Myriad are going, not to mention the rest of the infernal bunch, it's only going to get worse. Monsanto destroy ecosystems, food production and farmer's lives, Myriad cripple medical research.
Well by that logic I could patent the sun and by extension nuclear fusion, and I demand royalties for all sunshine that falls on the Earth.

And that's why it has to be fought for with unyielding fury; even if minds have to be shattered and people left gibbering insanely in dark corners, the human genome must remain unpatented, and patent laws WILL be reshaped.
