The problem is when the legal system refuses to separate emotion from reason and decides upon a draconian punishment which does nothing to solve the problem. If they find out that they are unable to treat his disorder, or if they determine that he's just nuts, THEN we can talk about locking him up for life. I don't wish any disrespect to the victim's family or the deceased, but I don't think it's right to just throw murderers away and forget about them without attempting to treat the problem.

I don't mean like "oh man he's just crazy man he doesn't know what he;s doing man!" but to just lock him up and treat him like an animal would be wrong if he was suffering from paranoid schizophrenia for example. Frankly as harsh and cold as it sounds, when passing out punishment there should be absolutely no regards to how the family of the victim, or the victim themselves (obviously not applicable in this case) feels that the criminal should be punished, if you let that happen then the system stops being about corrective justice and just becomes about pure retribution.

They deserve their revenge, and if that is knowing that he is thrown away for a lifetime, then that is what they should get. Unless, of course, this was all about some affair that the woman had which got her pregnant, then I just don't have anything to say about this case. Justice is as much about punishment as it is about rehabilitation, either way, the victims should be re-payed by their wrong-doer.

The justice system should be about justice, not retribution.

If it is only based on his word, and if he's found mentally incompetent or his confession is thrown out for another reason, then you can't even prove the sex was nonconsensual, much less post death. I think they'll get him for her murder, with extra time for the fetus, which means he'll be spending the rest of his life in jail. Every time he comes up for parole it'll be almost a go, except for the fact he also killed an 'unborn baby' and that'll cost him an early release.
