Hmm. Definitely changes things then, but there are still people out there who have patents who do not enforce them, so there must be other criteria met to lose your patent grant.
The does say, "may" not "will". But this is an interesting discovery for me non the less.

I only learned about it through the whole Zenimax Mojang lawsuit. This article explains a lot.

As you pointed out, I'm hardly an expert, but I'd imagine that you can lose it if you try suing one person/company, and they are able to point out that you didn't enforce it for a large majority of the claims.

Aren't trademarks and patents vastly different in legal aspects? I would assume they do share some similarities and this could be one of them, but I wonder.

I think what mostly sets this case apart from other patent lawsuits is that Apple actually requested an outright ban on Samsungs products instead of requesting money or royalties (which is what Motorola when initially went for) which is arguably a huge step up from the standard patent war.
The entire patent thing is pathetic and it needs resolving (so this bullshit stops) however Apple is doing the entire situation no favours by actually going for product bans.

damn right but it's both apple and motorola's fault for placing monetary gains over advancement of the mobile platform.
that problem exists with a lot of these corporations that abuse common law and the consumer.
microsoft is the high score keeper when it comes to this but i guess a lot of companies wanna beat that score.
