Either way though, that person is out of money (either with Gold subscription or a console). You'd think though that if these people are pirating the game then should have a bit more of a harsher punishment placed upon them.

Who the fuck would play a pirated game on Xbox Live? That's like leaving all your personal information at an accountant's desk after robbing a bank.
My cousin played pirated games, probably still does, on Xbox. His entire 360 got banned, so he got a new one and got it re-chipped and it was fine - probably a dodgy pirated disc lawl.
Those who get caught pirating this stuff because they're dumb enough to sign into a service monitored by the very company they are stealing from need to burn in a fiery pit.
