This is one of the handful of reasons why I don't give Nintendo my money anymore. Sucks too because I have a whole bunch of Nintendo stuff from when I was a kid. I wonder if they still run Nintendo Power, I have all the issues from the first up to the Gamecube days.
I wanna support Nintendo, but they make it so hard with these asinine decisions. They need to completely overhaul their policies for these situations.

I think people aren't really fully grasping the legal situation in this case: Nintendo allows people to stream content of their games, the way youtube (and seemingly the DMCA) seems to work, is streaming other people's content is bad. So Nintendo can just shut down whatever channel they want, for any reason whatsoever if they stream their content. They can then be selective with the rules, e.x. no ROMs, even if ROMs and Emulators are completely legal. The legal argument does not intersect with his use of ROMs whatsoever, it's up to Nintendo.

nintendo got game rentals outlawed in japan over 20 years ago and they're still illegal to this day. they tried the same shit in america but failed. fuck nintendo

If nintendo really wanted to stop people from distributing ROM hacks or ISP patches they could have had SMW Central shut down by now.

Nintendo's attitude might have something to do with the fact that the release of Nintendo's first console, the Famicom, heralded forth a golden age of bootlegging in which countless bootlegs, demakes, 999... in 1 cartridges, and ROM hacks were created and sold for the NES/Famicom as well all the "famiclones" that ripped off Nintendo's hardware. Even now early Nintendo consoles remain a favorite among bootleggers.

I think this is mostly effecting to youtubers who have partners that gives them money on their videos. I don't know if there's a way to control what videos can individually get money off of views or not.

The legal argument does not intersect with his use of ROMs whatsoever, it's up to Nintendo.[/QUOTE] Actually dmca doesn't blanket cover this, if anyone actually had the resources to take Nintendo to court they'd probably win against them on fair use grounds, as such though the hosts of these videos could also be dragged to court or worse, shut down for non compliance so they have set up a system that makes it incredibly easy to claim dmca violations but incredibly hard to fight frivalous suits. What they are doing is probably illegal, john Stewart or Viacom didn't get taken down for using recorded footage of news clips, this is a derivative work, but the people Nintendo is going after have no real clout to fight it. DMCA is grossly balanced in favor of rights holders and direly needs reworking, but it doesn't blanket cover work there is fair use clauses that need to be greatly clarified This is for streamers, as for emulators, again there needs to be greater clarity, there has been exceptions for other types of emulators, nobody's challenges Nintendo in court which is how they get away with this

So nintendo will have a pretty hard time enforcing it.

Y'know, the days of the GameCube and 20 years after the Famicom. If I remember right they also steamroll'd a bunch of Famiclones, again, at a time when nobody played the NES anymore.

You already can't mention it on Miiverse and ever since Nintendo themselves became sponsors of the larger Smash tournaments, only official Smash games are allowed. That's why you don't see it on their line-ups anymore. Honesty, that they haven't gone after the mod itself is probably because they know that's a wasp's nest. They're probably kicking themselves for not doing it before it got popular enough to become a threat. Plus it's so widely-distributed now, it'd be pointless to try.
