No, that's not how it works. An estate is your assets minus your liabilities after you die. If your estate loses a lawsuit that's simply an extra liability. However, if your liabilities exceed your assets the debt [b]does not[/b] get passed on to your next of kin. It just disappears, basically. Even if this guy does manage to win the lawsuit it's very unlikely that he'll be able to collect much money.
The only debts that can be passed on to next of kin are loans and such that your next of kin cosigned with you
