This is why you don't fight as a terrorist force.
Insurgents (technically anyhow) and soldiers are afforded rights. They are either fighting for their freedom or they are fighting to defend their homeland. In either case they can be reasonably assumed to be protecting their people more or less by attacking soldiers are targets of opportunity. While I don't like it when our soldiers are killed, one must always offer a degree of respect to these groups.
Terrorists (God I hate that word now. The media has stripped it of its proper meaning) however use people as camouflage. They intentionally appear as civilians (as opposed to insurgents who actually ARE the local civilians) in order to carry out their strikes on civilian targets, or foreign military targets on foreign military soil without regard or affiliation to their parent nation and its relations with the target. Their intention is to use fear as a weapon in order to exact change on the target country (Hello TSA how are -OH GOD WHAT ARE YOU DOING I NEED AN ADULT! I NEED AN ADUUUUUULT) and the do not care about the local civilians getting hurt as a result.
As a result none of the rules work. They are nearly impossible to convict because how the fuck do you gather evidence in many cases? Plus, who would convict them? They aren't citizens, so conventional judges don't apply, and they aren't POW's so the military courts can't put them on trial. They aren't under anyone's legal jurisdiction. Can't send them home because their home countries are frequently the ones who secretly fund them anyhow and the risk of them being successful the next time they try something is simply too great in many cases. What also frequently happens is their parent country doesn't want them back and strip them of their citizenship, creating stateless prisoners that we can't do anything with. This is the problem with terrorists. We have no options with incarcerating them. Affording them the same rights as soldiers defeats a huge part of why we afford rights to soldiers in the first place.
The prison has housed a bit under 900 known inmates in its lifetime and currently houses roughly half of that. Not a lot of people are sent there, and a fair portion of them are discharged. I find this favorable to simply executing the lot of them.
Torture however, is not okay. We have reasons for imprisoning them without trial, but government sanctioned torture is indefensible.

Some americans seem to get upset if their country is criticised or one simly says he doesn't like it.
Your government does bad decisions and deserves the critique. Whats so offensive towards you in it?
