Thepiratebay guys does not share files, they just host the ".torrent" files on their servers. The users can get charged for piracy depeding on what the laws in their countries say. There are a lot of people who have been charged for piracy, even through TPB.
The only way this is getting resolved is by reducing copyright and patent lengths. That's pretty much the only way.
