If you don't fear for your life then you aren't legally justified in firing... But stop. Like he said, this has been drug out far too long.
and if you fear for your life when it's super obvious that it isn't the case? This castle doctrine/stand your ground bullshit where you can just say "oh i was in danger" and you're off the hook is dangerous.
i hate to comment again but being knocked off your bike and punched in the face and beaten is pretty good grounds for having your life in danger
Adding to this, it isn't as simple as saying "I feared for my life". The claim that you feared for your life has to be reasonable. In this case, it clearly was given that the man wasn't charged with a crime.
3 people attack you=/=it's super obvious you aren't in danger. Just stop.
Totally wasn't my point but okay. I'll ask it again because you're illiterate. If you fear for your life when it's obvious you're not, can you still use that excuse?

If you fear for your life when it's obvious you're not, can you still use that excuse?
No, but that's so irrelevant it's hilarious. You are debating the legality of shooting when you justifiably believe your life is in danger by saying "but what if it isn't?".
Now Goblin, you make an interesting argument, and you say there are alternatives the man could have taken. Would you care to provide a few of these, just for argument's sake? For surely if there were alternatives (emphasis on the plural) that are blatant, you should be able to supply numerous ones. Please respond.

Jesus christ people, he felt that his life was in danger. He had no idea that he was only getting mugged (who knows, maybe one or all of them would have given him more of a beating for shits and gigs), so he acted in response as such. I don't have much sympathy for punk kids. Especially ones like those. They don't get far in life and they most likely will wind up dead at 30 for OD'ing.
I'm sorry you disagree with the idea but basically American justice works like this: You don't have to take a beating. Ever. Nobody has the right to hurt you without just cause. Now unless they threaten your life, killing them in self defense isn't generally okay, but sending them to the ER? Just fine. A 65 year old man is definitely in fairly serious danger if three teenage assailants get the drop on him and start beating him. This isn't to say that the teens deserved to die, merely that the 65 year old didn't have to risk his physical well being to accommodate people physically assaulting him.
Hey if we're talking worst case scenarios here, in this case at the end of the day I would rather want to see one dead old man and 3 kids in prison than 3 dead kids.

In the long run it saves lives.
It would probably make their peers think twice about doing what they attempted to do. In the long run it saves lives.
So prison is less threatening than getting shot and killed? I'm sorry, but what?
