A lawyer came out and said it doesn't work like that
While I'm not disagreeing (I have no opinion on this matter) I would caution against taking the word of any one lawyer in isolation. Law functions as a method of settling disagreements and as such has people who will be on opposing sides of nearly any legal issue. Unless that lawyer is representative of the legal community at large I would recommend skepticism

Customary law (aka practice) is, after codified law, the second most binding form
Good job Nintendo. I'm sure all these little fan made games were really making a dent in your revenue streams. Christ, I don't think I've ever seen a company this fucking dumb when dealing with their community. The only thing Nintendo is doing is shitting all over the people that actually care about them.

They were making money off adverts. It was mostly because games using Nintendo IP were on webpages that were generating revenue via adverts.
These web pages display images of Nintendo's video game characters in connection with unauthorized online games that copy the characters, music, and other features of Nintendo's video games. The web site at gamejolt.com generates revenue from advertising banners displayed on the site and advertisements played while users wait for the games to load.

Also gotta love how there's at least 24 "Five Nights at x" games in there
What does that have to do with anything? Nintendo and Scott Cawthon are very different things.

Little known fact: they also rehash games
Sometimes I wish nintendo would just spontaneously combust and die just on the off-chance that a company that actually cares would pick up the IPs and give the fans what they want.
It'd almost be impressive if it weren't such bullshit.

I could only imagine a world with Metroid by Bioware, Zelda by Ubisoft and Mario by Activision.

Fat chance, the company is kept afloat by nostalgia gamers which allow them to pump out more marios.
can you all stop ignoring that GameJolt (and the fan developers) were making money off of Nintendo IPs without permission and no sane company, Nintendo or not, would or should continue to let that happen
Like if money wasn't involved here I would understand your frustration, but GameJolt and the devs were directly profiting off of ads that play before the game starts.

Yeah the GameJolt ones were deserved, AM2R was actually uncalled for.

And who cares? Are they gonna lose money because of fangames with less than 1k downloads?
And who cares? Are they gonna lose money because of fangames with less than 1k downloads?
Who doesn't care? It's scummy as fuck to use other's IP to gain money. They're in the wrong here, doesn't matter if Nintendo loses money or not.
I could only imagine a world with Metroid by Bioware, Zelda by Ubisoft and Mario by Activision.
So basically Zelda's Creed? Blech, no thanks. Granted, I've only played one Creed game, but it lost my interest faster than Nintendo is losing goodwill. Nintendo often treats its fan base like dirt, but at least with Zelda: Breath of the Wild they seem to be trying something new with the open world format, rather than just stuffing it with a thousand meaningless collectibles and climbable towers.
Times like this make me glad I stopped buying their stuff and will continue till they stop their typhoon of bull crap.
You people are missing the fact GameJolt was making money off these games.
What do monetized youtube videos count as then?
An honest question.

Or hell, Newgrounds for that matter
They also have to protect their trademarks and copyrights otherwise they loose them.
Yea it's a dick move and could be undone by Nintendo but right now if you are using a Nintendo IP for a fan game, I would be going dark and pulling it off for a few weeks until this shit blows over.

Unrelated to Nintendo but related to that site, pac0master is attempting that ship sinking simulator again.

I never get why people prematurely announce their projects. Like that guy who was remaking metal gear solid, it wasn't any further than a tech demo and got C&D within a week of public reveal.
For fuck's sake, at least have a playable demo first, or like the metroid 2 guy just release the whole thing when its completed.
Or do something like a spiritual successor. I mean shit you could call Mighty Number 9 a shitty Mega Man fan game.
Fat chance, the company is kept afloat by nostalgia gamers which allow them to pump out more marios.
Nintendo is kept afloat by its ability to bleed money for extremely long periods of time in relative safety. Loyal fans, on the other hand, are a resource that are very rapidly dwindling for them.
While I don't agree with the users making money off of the IP, it's interesting to note that in the DMCA takedown letter, the email address is from mm-nintendo.com which is owned by a company called MarkMonitor who is working on behalf of Nintendo. So, basically, this isn't Nintendo themselves, but just some company they outsourced "brand protection" to. This bulk takedown seems more like they sent a crawler to look for "zelda" or "mario" and whatnot rather than knowing what they were looking for.
or like the metroid 2 guy just release the whole thing when its completed.
Erm he announced the game eight years ago and had a public development blog up for it that was updated once a month with in depth status reports and demos. Also he didn't release it fully finished. He released what he had in time for metroids 30th anniversary with the intent of patching it over time to get it fully finished (he was only able to release one patch before getting shut down)
He kinda shot himself in the foot releasing it early and thus jumping into the spotlight (and nintendo's crosshairs) but hell if I'm gonna blame him. Metroids 30th was a golden time to release something.

well it was 'complete' enough to be finished and speedrunable, combined with being labeled as v1.0
i don't even know what he could add beyond that, just fix

We probably will never know now. But he said himself what we got is not the "definitive" vision he had for the game, and additions and features would get added later. It was explained on a now deleted blog post but yeah who knows how major those additions would've been. The only one we know for certain is what the next patch was gonna contain an 'improved' soundtrack (+ album release)
Beyond that will forever be a mystery~~
aren't all of these just shitty flash games from 2002?
An alternate title for this thread could be "Nintendo lawyers confirmed to hate their PR department coworkers"

Yes, it's just the sheer number of them that were just DMCA'd is astonishing.

Nintendo's been taking down YT videos for a while now, and Newgrounds is probably just either under the radar nowadays or in the paperwork process.
