It's not about the lack of empathy specifically. A lack of empathy could mean a million different things psychologically. It's a combination of factors that leads to a person being a sociopath or psychopath. A lack of empathy is just a potential indicator that there are some issues.
And I'm more about recognizing that the mental healthcare system in the US is FAR more terrible than the issues with the general healthcare system.

Mental healthcare is the responsibility of the parents, most of the time. For the most part, mental health issues like sociopathy and psychopathy show themselves at a young age.
And IIRC, his mother attempted to seek help for him, but couldn't for some reason or another.

How about we take one of the most legally complex and confusing areas of law and add even more legislation to it! Forget the NFA which will cause you to go to jail for 25 years simply for taking a grip off your rifle and slapping it on your handgun. Forget 922r, which is another federal felony offense, and simply involves making sure foreign weapons have most of their parts stamped with "made in USA" on them.
How about we even go more into the madness and require certain small pistols of a certain caliber to have ridges etched into their trigger to make them legal for import!?
Haven't we had enough of laws that completely fail to accomplish anything useful? Hell, does anyone realize the level of jobs such new laws could cause to be lost? Not only that, but an unbelievable amount of small businesses.
Restrictions against the law abiding citizens will never accomplish anything, nor has it ever.
Want to stop gun violence? End the war on drugs and go after illegal arms trafficing instead, you know, enforce some of the laws we already have that would prevent all these bad things in the first place? Instead, we have the people who would be doing this busy cruising the streets to ruin the lives of people committing victim-less crimes.

Regardless, we're talking about this from a legal standpoint, no? And from a mental standpoint, you should also be prepared to kill anything you shoot at, whether or not you "intend" your bullets to be non-lethal is irrelevant. An intention is no going to stop a man's bleeding or give him his kidney back if you miss.
