The logical fallacy of a "War on Terror"* is considered a conflict subject of the laws of war. And since "Terror" has no borders or nationality and sketchy, malleable definitions, the removal of rights under the laws of war is a fucking stupid idea. Call me naive, but I don't think they're intending to, say, expatriate the Occupy movement. For one, that'd be stupid because any attempt to exploit their non-citizen status (like sending the military to detain them as this article suggests) would result in an absolute bloodbath. For two, I'm gonna call incompetence over malice in this one. Fighting terrorism effectively and legally is actually a pretty difficult task, and I think Congressmen like the ones that introduced this bill are intending to try and aid that. It's just that they're idiots. They go, "Oh, well that legal procedure gets in the way of catching terrorists? Just get rid of it!" and don't think of the greater implications for the rights of American citizens. Oh yeah, and anyone who says that Bush "wasn't that bad" needs to sit and remember that he set up the precedent for all of this shit. The "War on Terror" was his idea and that's the bullshit logic these congressmen and the ones who introduced the detention clauses in the NDAA are operating under. *Terrorism, like drugs, isn't a state that can have war effectively or legally declared or waged against it.
So if it passes, it just gets overturned by the Supreme Court, whoopty-doo.
