I used to ask if this exact situation was possible all the time. I guess I finally got my answer.
I have an interesting question/thought experiment: If someone, underage, makes child porn of themselves completely of their own free will and then when they come of age choose to share it with other people is this an issue?
In the eyes of the law it currently is, but should it be?
Yeah, because their free will as a child is moot.
The whole thing about the definition of underage and the arbitrary number of 18 is a full load of shit in the US. I mean like yeah we need it so a bunch of old guys don't go around fucking 14 year olds but there has to be a better way of going about this sorts thing
As was said in the other thread about age of consent, the only legitimate reason against underage teens sleeping with adults is the exploitation factor, but exploitation is a major factor you need to take into account at any age when it comes to sex.
When I was underage, I slept with a significantly older woman and I loved it. I don't know why she did it, but it wasn't like I was complaining. I knew she was using me for my age and she knew I wanted her experience. If a younger girl likes older men, why not? Maybe she prefers older guys, which is totally understandable considering she might find them more physically attractive and boys at her age are fucking dumb.
I'm surprised laws like these aren't being called for bullshit more often. It's stupid shit like this makes me want John Oliver on Last Week Tonight to point this idiocy out in one of his segments just so people can see this. Lives are being ruined by fucked up laws because teens are being teens.
Yeah, because their free will as a child is moot.
Why? If they do it, no one ever sees it, and they keep it until they're an adult who can make the rational decision they want to share it, why is that moot?

Because that's very easily exploitable.

Because (and I might be completely wrong here) you wouldn't be considered competent/able to judge your actions as a minor, so whether you did because you wanted to or because someone told you to becomes irrelevant.
There is also the problem with proving you made the video completely on your own without being coerced by anyone. Since as far as I know you can't legally sign contracts/statements saying you are doing this completely out of your free will.
Good question though, I would like to know more about it myself.
Would a jury seriously convict this kid for 'pornography' of himself? Can't people realise they're going to ruin a kid's life for something that isn't even morally/ethically wrong just because of a loophole in law? Seriously, what the fuck is it with prosecutors always going for the max sentence possible regardless of context?
