I don't really know how you came to the conclusion that this is "Orwellian"; it isn't, not in the slightest.

We didn't basically say the same thing, though, you said that the punishment [I]shouldn't always be stretched out to that of the real thing[/I], which implies that it is/should be a crime to begin with, just one with a lesser penalty. My mistake if I understood your position wrong, you first stated that you agree with the US ruling (protected speech), but then your last sentence appeared to contradict the first.

My 'Orwellian' descriptor is applied to the stance that the government should outlaw the drawing of heinous shit.

Edit: slightly off topic, but I've been reading through some SCOTUS cases these past few weeks and I gotta say, they seem to generally go fucking hard on protecting the First Amendment. It's pretty awesome.
