One thing us humans are born with, something that MAKES us human, is our massive caring for other humans. To not have that, and to murder someone/torture someone DOES make you below humans because you lack something important to our superiority as a species.

Very little of these kinds of people are in the right frames of mind to understand penalties or even what they're doing. Our end of the deal is to get them the psychiatric help they need to become functioning members of society.
