Uh it basically IS free with the humble indie bundle. I got a gift code from someone who bought it and you can pay your own price, which can be extremely low.

Not that Wolfire is the type of company that would ever want to get involved in a lawsuit, but if I was them I'd definatly sue. It clearly states in their liscense that the actual content of the game is not open source and allowed to be redistributed, and clearly states that the open source can only be redistributed for non-commercial purposes:

No, because in this particular situation, someone else is making money off of this guys work. If it was free in the app store, then we'd be mad at apple for not taking off the blatant warez.

Well there is a bit of truth in it. By not releasing demos game studios are hurting their sales, since nowadays they all expect you to pay for your game before you even get it (preorders) or get a chance to try it. And then try to stop you from selling it to someone else if the game is shit.

It's copying and REDISTRIBUTING FOR PROFIT.
Here's why this case is different than a standard case of piracy:
-The average pirate doesn't want to pay for software in the first place. There was no intention of ever paying for that software, which is the primary argument for people who believe pirating shouldn't be illegal in a non-commercial sense.
-The people who buy iCoder's version of this game have money they want to spend on Lugaru. There's the intention of spending money. But instead of giving money to the developer, in order to help support the development of Lugaru, he gives it to iCoder, who is a third party who has no intention of giving any of the money to the developer of Lugaru, but instead wants it to line his own pocket. The end user gets the same copy of the game, but the developer gets nothing, even though he should, because the end user spent money on the game.
If I were a guest at your home for a day or two, would you like it if I put up a for sale sign and tried to sell your house? Not a perfect analogy, but the idea is there.
And if you want to say anything about the GPL licensing, it's only the source code released under GPL. The art and other assets are not. So just for the art, iCoder could VERY easily have a lawsuit to deal with.
