Uh, the way I see it is that Blizzard started making Blizzard DOTA after Valve announced and started making DOTA2, thus it should be Valve taking Blizzard to court. But overlord Newell knows it's best not to bother with such petty human matters.

EXACTLY! Nobody claimed rights for the game until now. Blizzard ignored the mod completely until they see now that its profitable, coming with a ridicule excuse to avoid VALVe from copyrighting it.
If you ask me, DOTA should go to VALVe, not only because both the creator of the game and the man who stood by the game for years (And still updates the W3 version) but because they are pulling out a great game and in no way, had intentions of fucking over Blizzard(While Blizzard DO want to fuck over VALVe).
But of course, like some people already said, maybe the W3 editor has some sort of EULA that would make everything made in it owned by Blizzard so technically they do have the right to own it even if its not cool.

Basically they are next to impossible to have upheld in court. And in a case like this, it would be even harder.

Actually, Blizzard promoted DotA alot. There were competitions for it and a DotA segment at their conventions. They didn't ignore it completely.

I was under the impression that Valve was trying to trademark "Dota 2" for their own game aswell as "DOTA" for the original game, but I could be wrong here. Either way I don't think they should be able to claim copyright over the first game and the term "DOTA"

Valve can just name it Dota All Stars 2
DotA DID use assets from WC3, but that's only the platform it was on. Creators have full rights to it, and Icefrog got hired by Valve.

A lot of stupid shit, I must say, I thought legal actions of this level would have something much better. I realised they have nothing else to say. Basicly 'oh they used w3 shit in dota' arguments that mean nothing to valve since valve has none of the w3 file/assets. There were battle.net arguments too, saying that you can only play dota using battle.net, blizz's servers. The attorney forgot about the fucking LAN function which is used in the majority of clanwars/tourneys/gather sites like garena.

I have never seen blizzard advertise dota apart from that semi-new video about "blizzard dota" in starcraft2. Am I the only one or am I fucking missing something? Also warcraft.com leads to a fucking wow page on battle.net for me. NOT ANYWHERE IN THE MENTIONED LOCATIONS CAN I FIND DOTA MENTIONED/PROMOTED AND BEING GIVEN FOR DOWNLOAD. Also does downloading maps in-game actually use battle.net servers? Doesn't it work like skype? One person sends another over a program, but doesn't use the provider's servers? Basicly torrent based system right? Or am I wrong?
Yeah, the version of Battle.net that WC3 uses has you download maps directly from the host (who, I might add, literally hosts the game). Blizzard's servers only exist to facilitate a connection between the two.

And even if Blizzard were to mention or endorse DOTA, that is all they are doing. They don't have any claim to it any more than I have claim to Team Fortress 2 or Skyrim because I recommend those to my friends.

I would understand the majority of blizzard's complain if valve used w3 assets, but they didn't. They have their own assets and all that could've related dota2 to w3 was the text base part, as in names and character lore, which was changed.

There usually is no debate in such things, that's usually set in contractual stone. When Westwood was dissolved from EA, they didn't own the rights to the Command&Conquer franchise, EA did, because EA said "Alrighty, this here prop'rty's mine, y'hear?" when Westwood got bought up by them.
So when Valve brought them in one of two things happened:
1) Valve said "We own this now and forever"
2) Valve said "It's still your property, you can take it with you if/whenever you leave".
