As a smoker i consider this utter hogshit and am glad i live in a different country. I don't know about the US but generally smokers over here are considerate enough to steer clear from non smokers when having a cigarette, and also to throw their cigarette butts in the ashtrays provided on literally every bin on the street(but not always i admit).
Still, stepping on a smouldering cigarette butt with bare feet while at the beach is an absolute nightmare.

Littering is already punishable with a fine so people shouldn't even be allowed to use that argument.
I personally get annoyed by coworkers using the fact that they smoke to get out of work. Other then that.. I really dislike the smell plus it gives me a headache when I'm around it for more then a few minutes. My parents smoked until I was 16 until they moved outside to do it. I think this is a bit much, but if they do it good for them.. if not.. whatever.
