He did not inherit her share, since she did not actually die. So if they ask for her share they aren't taking anything from him that he wasn't already going to lose. What he's asking for is to be given everything, including his wife's portion of their assets. So he's saying "she killed the kids and is in prison, let me have everything and start a new life". Not so fast buddy, what she did was evil and she deserves every bit of punishment coming her way, but that has nothing to do with the distribution of assets.
He could sue her, for pain, suffering, and denying him the ability to enjoy his children(at least in the US he could). But it is likely that by the time that lawsuit hit the courts the state would have taken their share and there is no way in hell he's getting it back from them.[/QUOTE]

He's going to lose her half of the house which was never his in the first place. The situation makes perfect sense.
I often wish people would treat all media with the same criticism they do, say, Daily Mail on this forum. No reporter seems to be above seeking the right kind of publicity for their stories at the cost of accuracy - even going as far as libel.
Belgium, the worlds most boring country(according to Jeremy Clarkson), also has a fucked up legal-system. Big surprise.

Think of it like this:
Let's say you're married, and you and your wife own a house. Your wife then drives drunk, hits another car, and kills and injures people in that car.
They sue for damages and win.
If you don't have the money to pay off the lawsuit, or enough insurance to cover it, guess what? You'll have to sell the house and give them the amount owed, you get to keep any left over money. If your house doesn't sell for enough to pay off the judgement then you'll have to hand over all the money and you'll STILL owe more.
And you didn't even commit a crime.
That's because legally married couples share assets. As far as the law is concerned, whatever your wife owes financially, YOU owe financially. The fact that your wife committed a crime does not separate you from her financially. That only happens after the marriage is dissolved(divorce, annulment, etc).

Since he can't live in a house he only owns half of he'll most likely be forced to pay up the rest of the contract or be evicted, right?
Also it doesn't say the conditions under which the house was purchased, perhaps he bought the house before the marriage himself but due to him getting married he would have to pay what he already has paid. meaning he's losing part of a property he has already paid for.

Usually when you own half the house with your wife or husband, and the marriage breaks up, the house is sold and the money divided in half. If one person wants to not sell and keep the house, usually they have to buy the other person's half. So if you had a $300,000 house, and wanted to keep it, you'd have to pay your ex-wife her $150,000 share and the house is now yours.
In this case, the guy would split the money from selling the house with the government of Belgium, since they are taking her share to pay for her prison time. Or he could pay her share and keep the house- his choice.
If there is some kind of prenuptial agreement, his assets would be protected, that's true. But if that was the situation I don't think he'd be complaining now.
If you own a house, then get married with no prenuptial agreement, you just gave half the house to whoever you married. That's how it works, that's why people should be careful who they marry, it could really screw you up if the marriage breaks up and you picked a loser for a husband or wife.

Upon marriage assets are transferred equally unless you sign a prenuptial agreement. Above guy elaborated more.
