Pretty sure they mean the edge of the mattress. I don't feel sorry for the guy but I definitely think a manslaughter charge is more justified than a murder charge. He made a drunken mistake, he didn't intend to kill the kid.

i have an alcoholic mother and I'm like, one bad day away from practically banning it from my own home, and even I know that an alcoholic can think rationally enough to not actually MURDER a child
I mean, I agree that maybe the manslaughter charges should be considered, but I'm not sure if I can personally agree that they should be applied

You're right, he was thinking rationally enough not to murder a child. He unintentionally killed the child. That's manslaughter.
Do you people really not know the difference between murder and manslaughter?
Because that's kind of worrying
Every single thread like this all i hear is "I am angry and disgusted at this person therfore he should go down for murder even if the death was accidental"
For the last fucking time ..the abuse..the throwing the kid around..the drinking Isn't a goddamn thing to do with manslaughter..no matter how you may view it
The fact he killed the kid without meaning to is..therefore ..he could be a goddamn nazi and it would still be manslaughter
it doesn't matter who what where and how ...as long as it was accidental
It's manslaughter
The article is pretty short and the video is not playing for me. So they just left the kid there until morning and then took him to the hospital?
That is so fucked. Too drunk to drive I suppose.
I think he killed the kid, as in murder. However, thinking it and proving it are two different things. If the mom backs up his story of meaning to slam the kid on the bed and 'missing', then the most you can geg him for is abuse not murder. Probably not even manslaughter because while manslaughter doesn't require the same intent as murder there usually is some element of depraved indiference involved. That is, you did something that you knew might cause major harm, even if you didn't intend to cause that harm.
If you accept he was aiming to slam the kid on the bed, then you admit there's no way he could have foreseen death as being a possible outcome.

Good thing you're not a prosecutor then.
