Just 40 years? Life imprisonment. It is one thing to kill an adult, but to kill a defenseless 2 year old who had no idea what he had done? Horrible.

Can they not automatically change the charges from aggravated assault to murder now that the kid has died?

says in the article they are considering filing more charges, and most likely will, this is obviously much more than battery now.

That's fucked up man. That man's lived a hard life, his dad was in prison for most of his childhood, grew up poor as hell, saw his brother killed by a drunk driver when he was nine, tore his ACL last year and everyone thought he done, and now this happens.

As much as I love AP as a player on and off the field, he's handling this really really poorly. He's going to play tomorrow and he left to go practice while his son was in critical condition. That's really fucked up.

In the other thread on this story there was a rumor that he did not officially acknowledge this kid as his son before this attack. I don't know if that's true or not, but it would explain the distance between him and this child's fate. It could be one of those situations where yes technically it's his son, but he wasn't the kid's dad if you know what I mean.

thats unlikely and thats still 20 years an other inmates knowing he beat up a 2 year old wont go well

My friends dad got 40 years just for selling drugs. I think killing a 2 year old deserves a bit worse sentence.

He has the right to do whatever he wants. He had left to go be with his son before he passed away as soon as he heard about it all happening. His kid was practically in a coma, so he couldn't do shit but go practice.

The charges so far are "aggravated battery of an infant and aggravated assault", the 40 years is for those. Murder charges are likely to be added since the kid died.

I haven't seen any stats but if I was betting on it I'd tend to think the risk factor goes like this:
#1 risk to abuse kids= parents
#2 risk to abuse- mom's new bf
#3 risk- adult female babbysitter
#4 risk- sibling(child or teen)
