Depends where you are. The DMCA in America, as far as I know, only makes exceptions for educational purposes, parody, or review.
You could obviously argue fair use for most of them, but you could argue fair use for downloading an album from bittorrent as long as you don't sell it, as well.

Now that I think about it, probably everyone on this forum stole their avatar from somewhere else and if the avatar is of an existing character then it is copyright infringement.

In all seriousness, I am quite afraid of 4chan. Sure, most of the time they are too busy trading memes like it's going out of fashion but when even a small portion of them can be stirred into some semblance of concerted motion, it's quite terrifying.

yes its illegal, but it really annoys me when people say its stealing when its really just making a copy, hence the term "copyright." Its not called theftright or stealright
i'm pretty sure that if you steal a cd in a store, its not breaking copyright but it is still illegal

Which is theft, because you're taking data which you have no claim to. You are taking someone else's property. Property includes the intellectual and intangible. This is not that hard to understand.

Piracy is a first (uploader) breach of contract and later(each download) copyright infringement, and is pretty much never charged under laws regarding theft. It is not theft by most people's conception of the word, and is almost never considered theft in the eyes of the law.
That the average joe doesn't know what words mean is irrelevant. The legal definition of "theft" is also moot because it varies by state to state in the U.S., to say nothing of internationally. The fact that we have a term like "identity theft" these days should make it readily apparent to you that the word covers more than just larceny.

I've never heard of a single case of piracy that was prosecuted under any normal theft law in any jurisdiction.
I know the term as identity fraud.

You're the one presuming they got it wrong and that we should be using a legal definition or one from a particular dictionary, whereas I am telling you they are accurate and up to date unless you can prove otherwise.
And don't give me that load. They're not prescriptive because they can't be absolutely. Sure, change happens. We still need to agree upon meanings or symbols are meaningless. You deciding to freeball it because you can doesn't make you any less incompetent at communication.
This whole "argument" is an attempt by self-righteous children to deflect the negative connotations of the word "thief" because they'd rather pretend they're raging against the machine or something rather than greedily grubbing at shit they can get for free.
