He had a history of stealing, stealing is stealing.
If I came in to your home and stole one dollar wouldn't you be upset? Wouldn't you feel violated and unsafe at some level? Obviously this guy has an issue, just because the you read what the max sentence is does not mean he will get that.
I don't care how big a corporation is, it is a business not a charity. They can't just give shit away, the cups are suppose to be for water.
If anything he needs to go to a mental hospital or something.
I stole stuff too when i was younger.
mostly because i felt like i was somehow bringing down the institution by doing so, and because i wanted to impress a girl.

If all his convictions are minor petty thefts and all he did was steal a $1 soda, be drunk and refuse to leave that still doesn't add up to a 5 year prison sentence in any decent, first world country.

Maximum sentence is 5 years, that is as high as they can do. It does not mean he will get it.
People need to stop getting caught up on that.
Plus it is the three strikes law, he has previous convictions with the same charge so after you do that shit 3 times it is automatically upped to a felony. If you can't learn by then something is really wrong with you.

Yes, I know he probably won't get five years, I just think it's rather absurd that it would even be possible for him to get five years.
Also, three strike laws are fucking stupid, imo. It works in Kindergarten but not really in society.

3-strikes is dumb because of its arbitrary criteria, not because it addresses recidivism.

Not particularly, but I don't feel that the three strike system is any improvement over what we already have in place. I feel like it removes the severity of the crimes and pins an overly harsh punishment for the third offense.
The guy's a petty thief and a loud drunk, not a felon.

I didn't say it was dumb because it addresses recidivism. I'm fine with some kind of law in place to deal with repeat offenders, but three misdemeanors do not equal up to a felony, especially not when they amount to nothing but petty thievery.

stand your ground is a law in almost every state, though it's called differently in many states. He's bringing up a perfectly parallel situation in the same state.

It was designed to keep repeat offenders out of the streets. People demanded it after a string of murder/rapes that continued to happen after certain offenders got released.
It isn't suppose to scare people, because any reasonable will learn. There are a lot of people that do shit and barely cross the line because they know they can get away with it. Well they do it 3 or more times then they can't get away with it and it all catches up to them.
I mean, after 3 times of the same offense you got to start wondering.

I don't see any problem with this applying to rape which is much worse than petty thievery. My problem lies in the possibility that this man could go to jail for years for stealing a miniscule amount of merchandise and being drunk and loud. Spending over a year in jail is not something to scoff at.
The crime just doesn't fit the punishment.

Which is very iffy and, in something like the Treyvon(sp?) case, would likely get ousted without some manner of codified law in place.
The case law is still in place because it's rare to find someone stupid enough to actually exercise it. Most people have the sense to stand down or run when there's danger, and not up-the-ante and start a firefight.
Duty to Retreat tends to take precedence in non-codified Castle Doctrine.
