it was rule a homicide, not a murder
homicide could range from anything, including involuntary manslaughter to first degree. this is more like involuntary, but the doctor could be put away longer if it turns out MJ was addicted to the drugs he was giving him.

However what I heard on one of those late late late news shows, that he was talking to people on his cell phone for something like 47 minutes before even caring to call 911.
