Again, recidivism rates are lower in countries with looser penalties and nicer prisons.

Then you tell me my sourced quote from a supreme court justice who ruled in favor of the same case you were using to support your argument is worthless because he's "Just some guy." Ignoring the fact that he is a supreme court justice who even ruled on the case you're using to support your view. I would like more evidence. I am leaning in the direction that capital cases may be handled differently, though, I just want a bit more evidence.

In some states capital crimes might work like that, but according to Scalia's concurrence, it doesn't have to in every state.

The way I see it, no one would want to do anything, because if they're caught the same thing would happen to them. They rape? They get raped or something. They murder? They die They steal?
