The capsule itself as a whole entity is not FDA-approved. Note that it literally states -directly in the OP i might add- that the extremely low cost of the capsules is exactly because it is not FDA-approved. FDA approval of stuff isn't required to sell drugs. Companies do it because for better or for worse, consumers trust the words FDA-Approved, and it does make it easier to get the drug into the hands of consumers.

Means that the patents don't really apply anymore. They're just not as much used in the US as outside of it for a bunch of reasons.
