They did charge him. He's in confinement awaiting his trial.
It sure is taking them a long time then. He has been in solitary confinement for seven months now, that seems to be a bit excessive.
But he was not convicted, and is therefor innocent until proven guilty, which means it's illegal to incarcerate him.
Under civilian law, yes. However, under the Uniformed Code of Military Justice, they can detain you without bail until your trial in whatever confinement they see fit. Pretty sure I wrote this in one of my earlier posts.

[editline]16th December 2010[/editline] Also, you did not mention that before.
It's been 7 months and there's nothing about a trial. Is the plan to keep him there for the rest of his life, then?
His court-martial/trial is set to occur sometime in Spring 2011. So he'll likely be confined for a few more months.
It's funny how people sit here and claim he was never charged, when he was. http://cryptome.org/manning-charge.pdf I mean, what's happening to him sucks, but he's the one who fucked around with classified documents. Did he think the government was just gonna let him go?
Being charged is different than being convicted. A charge is nothing more than a formal accusation. Ive been charged for "mischief" and 'breaking and entering", but was not found guilty of either. I bet the court he'll be in will be the first time in a year that he's seen so many people, and these people will be the ones deciding if he walks or not, which he surely will not;.
Wikileaks is just a tool.
I can't believe that you set that up for a zinger so bad, and noone took it. Even though I don't believe the zinger it would be amazing. But this whole detainment deal doesn't suprise me, which is probably the most depressing thing about it. aw fuck it SLOPPY JOES YOU'RE JUST A TOOL sorry, if I didn't run with the zinger, noone would.
You really showed me :v:
I don't actually think you're a tool, but when you set me up like that, you can't expect me to do anything else :(
They're keeping a guy in illegal confinement until Spring when he's just gonna be chucked back into jail again? jesus fuck someone needs to tell whoever decided his punishment to resign.
It lets people notice that you're an idiot, so we can choose to ignore your arguments. [editline]16th December 2010[/editline] Also because it's funny seeing how silly the post was.
Because he made a mistake and corrected himself?
His court-martial/trial is set to occur sometime in Spring 2011. So he'll likely be confined for a few more months.
Okay so up to 13 months in solitary confinement, with the specifications being *No pillow or sheets despite never being on suicide watch *One hour per day outside of his cell, no access to news/current events *No exercising Something seems wrong about this.
And what happens if he does get let out? And proven to not be guilty? Then he would have spent 13 months in jail for a blatant accusation.
Note to self: do not join Military and piss them off.
And what happens if he does get let out? And proven to not be guilty? Then he would have spent 13 months in jail for a blatant accusation.
Yeah, that's not going to happen.
A big fuck you to the United States Government. -ThePunisher All this freedom malarky they bang on about when its really just a small group of fairly nasty people in control of things. The morality of this situation is sickening, he has shown the world what really goes on behind the closed doors of the government of the USA, which is deceit, lies and many legally questionable activities.
That's a fucking harsh punishment. Nobody in this world deserves that kind of treatment.
Why are people considering 'solitary confinement' not torture, i work in a penitentiary institute as a guard and i very well know what it feels like. Let me tell you, the human mind when bored is incredible, imagine having nothing to do all day for weeks straight. Usual time limit for our solitary confinement (Punishment) is around 5 days, and even then they are allowed 1h of air-time each day in a concrete room with open roof to they can catch a breather, this man does not have this luxury.
That's a fucking harsh punishment. Nobody in this world deserves that kind of treatment.
Disagree. Twisted necropheiliac rapist serial killers deserve this, because otherwise they're an 'actual' threat.
What people need to understand is that once you join the military, the military owns you until your term is up. When you get a clearance for secret, top secret, etc. You have to sign a large amount of paperwork that essentially says that if you break the trust the military is putting on you; they can lock your ass up for a long time. He signed the papers, he agreed to the terms. He broke the contracts, he's gotta do the time.
He is a traitor after all.
He's a traaaaaitooooooooor!!!!!
What I don't understand is the severity of his punishment
The thing is, the solitary isn't even his punishment. It's just his detainment. If he does get convicted, his punishment will be way worse. As sad as it is, this is what my country has become. I'm a true patriot. I love my country. I've come close to giving my life for my country. But I think this is just a little bit too far.

Despite all the controversy, wikileaks is doing a very good thing. If it weren't for them this guy would have disappeared.
It is possible to love your country without having to love your government.
Precisely. I love my country with a passion. But the entire federal government can go fuck themselves with a curling iron.
Despite all the controversy, wikileaks is doing a very good thing. If it weren't for them this guy would have disappeared.
And that's the biggest thing. I think it is fair to say that we, as the public, should be allowed to know what's happening in this man's life
I am all for interrogation/torture, but this man didn't do anything wrong enough to be tortured. This is seriously fucked up.
Try sitting in a room all day and night alone, you'll go crazy.
I probably start thinking of fictional characters.
What I don't understand is the severity of his punishment
Well considering day-to-day life in the military itself isn't that far off of being in prison.
