Meaning they are about as intelligent as us, probably.
Whales and dolphins are as intelligent as us, they just went back in to the water and don't have the ability to make tools or need to.
They're fully aware of their surroundings, they have free will and are able to make decisions. We just can't communicate with them besides training them.

I've been keeping and breeding crayfish for about 4 years and I can tell you they feel pain. The way I see it, If you can feel, you can feel pain. You touch something and it responds to your touch, you can over stimulate that sense and cause pain.
