Baseball is a hell of a lot better than soccer
this is a wrong opinion also, there were no remarks of him being called "stupid" or "a fatty". the announcers calling him out for sleeping is not grounds for suing.
also, there were no remarks of him being called "stupid" or "a fatty". the announcers calling him out for sleeping is not grounds for suing.
I doubt they'd upload evidence of it on their official channel, which is what that video is from
It's a pretty clear cut case of defamation. They can prove he's sleeping and would legally be allowed to call attention to it, they can't prove he's stupid. That's textbook slander.
did you watch the video i dont think you did mister
All you idiots saying $10,000,000 is too much have no idea how lawsuits work. They guy didn't choose that number, his lawyer(s) did. The point usually being to start at a ridiculous value because it'll get reduced by some factor regardless.
You know on the back of the ticket there is a disclaimer? "By using this ticket, the bearer agrees that:...(c) the Yankees, the Office of the Commissioner of Baseball and all MLB affiliates and entities and sponsors and licensees of the MLB affiliates and entities shall have the unrestricted right and license to use his/her image, likeness, name, voice, comments or other proprietary or public rights and that of any minor accompanying him/her, in any broadcast, telecast, photograph, video, audio sound, audiovisual and/or other recording taken in connection with the event or other transmission or reproduction, in whole or in part, of the event for all purposes, worldwide, in perpetuity and in any and all means and media now or hereafter, without compensation." They can use him to advertise if wanted
$10 mil for someone being rude really guess everyone on the internet is due for a payout sometime too then???
Here's the video (which will inevitably get DMCA'ed, either from some supporter of him, himself, or a lawyer he's going to hire):
How will it be DMCA'ed? When you enter the ballpark you agree to the terms on the ticket, which includes granting the media presence rights to film you and broadcast it. In the video they don't even say anything the guy says they said, either.
they somewhat insulted him when they started poking fun of the guy eating the chicken fingers. they said something like "better eat them while he's asleep so he doesn't ask for one." it isn't outright calling him fat but it does seem a bit offensive, though even if the exact same situation happened (chicken fingers guy right next to X) the joke wouldv'e probably been the same. that's the only plausible thing that he could be using for the "they called me fat" arguement.
They kept going back to the guy, I wouldn't doubt that there's more commentary throughout the match where they dropped the payload that didn't make it into the video. If they did say it, the editors probably didn't want to use it, or maybe it got cut out after the guy pressed charges I can't imagine that professional commentators would say that stuff though
I thought it was just be one of those shots where they put a sleeping guy on the screen for a few seconds. Instead it's like a 30 second commentary on the poor dude. I don't know if he deserves $10 million but those commentators are dicks.
I'm not sure what you mean by that. Baseball games are all boring as fuck as far as I know.
Not saying that humiliating him infront of millions is ok, but Yankees and Sox is literally THE baseball rivalry. That shit gets intense (seriously, im a basketball kinda guy but i went to a NY vs. Boston game before, holy shit is it crazy).
Not saying that humiliating him infront of millions is ok, but Yankees and Sox is literally THE baseball rivalry. That shit gets intense (seriously, im a basketball kinda guy but i went to a NY vs. Boston game before, holy shit is it crazy).
No it's not. The atmosphere of tens of thousands of people gathered for their teams is crazy. Baseball itself is literally the least physically interesting sport known to man. If he's tired, once he adjusts to his environment if there's nothing remotely visually interesting going on, he's going to nod out uncontrollably. Even curling is more visually interesting than baseball for fucks sake. [editline]7th July 2014[/editline] I'm not saying he should sue and win millons. But those announcers are cunts for mocking him so openly in front of millions even when they themselves are so much more interested in a fat dude nodding off than the game they're supposed to be calling.
Why do Americans hate baseball so much? I'm an Englishwoman, and I seem to enjoy it more than all of you. Perhaps because it's cricket-lite :v:
Why do Americans hate baseball so much? I'm an Englishwoman, and I seem to enjoy it more than all of you. Perhaps because it's cricket-lite :v:
It's like cricket, except the salaries are ridiculous, steroids are essentially mandatory at this point, and half the games end up running like an hour over their broadcast timeslot, eating up time for real sports.
lel
Sorry that I like actual physical activity in my sports. If I wanted otherwise I'd go play an SC2 tourny.
ho ho ho the opinions being presented as if they're objectively correct are overwhelming in this thread yo
Why do Americans hate baseball so much? I'm an Englishwoman, and I seem to enjoy it more than all of you. Perhaps because it's cricket-lite :v:
im american and i love baseball, although part of the reason being that my hometeam is really likable and fun to watch
defamed him by broadcasting his snooze on-air, allegedly calling him “fatty, unintelligent” and “stupid.”
when did the announcers ever say this? sounds like he's talking about himself
Why do Americans hate baseball so much? I'm an Englishwoman, and I seem to enjoy it more than all of you. Perhaps because it's cricket-lite :v:
It's facepunch If it's not the newest and coolest sick esports tournament it's probably not gonna be well received on here
I love how people are like "well maybe he shouldn't go on the internet" When you go on the internet and fall asleep on the keyboard, you aren't broadcasted to millions and having people with thousands of fans insult you.
It's facepunch If it's not the newest and coolest sick esports tournament it's probably not gonna be well received on here
Even then...
"allegedly calling him “fatty, unintelligent” and “stupid.”" How would the fat guy know the announcers called him that if he was sleeping to begin with, this wasn't even said on the video on the first page. Even if they did call him 'stupid' so what, this is such a common bottom-of-the-bucket insult, i would hardly call it an insult let alone tagging it 'defamation'. Kids say this kinds of stuff, and this guy is suing for 10 mil over some childish shit. The man was sleeping in the stadium and they commented on it, its kinda ironic that you would pay for tickets and food, just to fall asleep during a game, and the commentators pretty much pointed that out. I thought it was kinda disrespectful to be sleeping during a performance, and I consider sports to be a type performance.
How will it be DMCA'ed?
Various parties have an obsession for using YouTube's DMCA notice system to instantaneously get videos that aren't infringing down for other reasons behind the curtain, be it politically charged or not.
Baseball, home of such exciting moments
Tell me, when did you hear them call him stupid? Because I watched the same video you did and apparently missed it.
Just going by what's in the case he filed. The video likely isn't the whole broadcast, if he wants any chance at winning he isn't going to just lie.
Why do Americans hate baseball so much? I'm an Englishwoman, and I seem to enjoy it more than all of you. Perhaps because it's cricket-lite :v:
Americans hate baseball? We're one of the only countries that plays it on a large scale. [editline]8th July 2014[/editline] That's like saying "why do Americans hate American football?"
Why do Americans hate baseball so much? I'm an Englishwoman, and I seem to enjoy it more than all of you. Perhaps because it's cricket-lite :v:
Most Americans don't hate baseball, but I find it boring to watch. Hockey is a fuckton better.
Americans hate baseball? We're one of the only countries that plays it on a large scale. [editline]8th July 2014[/editline] That's like saying "why do Americans hate American football?"
It's just as big if not bigger in Japan

I read the comments on that video, Take it from a huge baseball fan: :suicide:
“Plaintiff is confused individual that neither understands nor knows anything about history and the meaning of rivalry between Red Sox and New York Yankee.
really? because I don't give a shit about the meaning of the Red Sox and NYY certainly not something that matters enough to be a douche about it [editline]8th July 2014[/editline] Even if its big in baseball terms, its still just baseball
You know what, this is not ok, he's being openly mocked about on a broadcasting reaching possibly tens of thousands if not millions (idk the size of baseball for you guys), for someone with self steem issues this is quite the pain. Also the price IS high, but if you wish for things to take an actual effect and teach an actual lesson, the cost for intentionally doing this sort of thing has got to be high.
