Should probably change the laws not to read weapon of mass destruction. The term WMD exists to differentiate between conventional weapons and more bizarre and dangerous materials. An explosive is as conventional as possible.

There was also a firefight between him/his brother and the police a few days after the bombing so they could be charging him for that as well

im pretty sure MA doesn't have a death penalty, or they haven't re-implimented one since they were temporarally barred nationally in the early 80s, which means they'll just throw life in solitary at him instead of trying to push the law

"mass" destruction, they were trying to kill as many people as possible as indiscriminately as possible, which is the mass part of destruction

This is a Federal case. Massachusetts' ban on the death penalty has no weight here.

The way our laws define things and how they are actually defined are different. For example, any Assault Rifle is classified as a Machine Gun under US Law, and there's no distinction made between an Assault Rifle, a Machine Gun, or even a Minigun.

They actually did though, they had those chemical weapons. People just says "There were no WMD's" because they're specifically thinking of nukes.
I'm at UMass Dartmouth. I'm pretty sure a lot of people will be drinking and celebrating tonight. The first weekend back after the evacuation I ran into a mob of 500 people chanting "Fuck Dzhokhar" for nearly an hour. :v:

I have never seen the term 'firearm' used to mean anything other than man-portable small arms. My guess is that either there's no specific charge for bombs so they're included under a generic clause in the penal code, or they were trying everything tangentially relevant that they could and the jury decided it was acceptable.

He's upset at the thought of Tsarnaev ending up dead for his crimes. Why, I have no idea. Overly sensitive about death? Naive idealist about the value of human life? Maybe he just likes riding a moral high horse?
Because the thought of Dzhokhar Tsarnaev dying either by execution at the hands of the government or in prison at the hands of other inmates is such a cause for remorseful feelings and is apparently a bad thing... for some reason.

If he dies, he becomes a martyr and inspires copy-cat crimes.
It's the biggest problem with rebels and terrorists. If you execute them, 10 more can take their place.

This is something I don't understand: in a prison with guards everywhere, why is anyone a "dead man" in prison? Why is this sort of thing allowed?

Is there any evidence that this is how it works, or is the martyrdom defense the default argument now against causing the death of terrorists?
Because traditionally, becoming a martyr involves dying heroically in the heat of battle-- not being euthanized behind closed doors on death row like an inglorious animal.

Well, Jesus for one. Killed like a common criminal, inspired arguably the most influential religion in world history.

I don't see many parallels between Jesus of Nazareth, a religious icon who inspired an entire faith built upon the principles of loving thy neighbor and generally is about being a decent and caring person, and Dzhokhar Tsarnaev, one perpetrator of a bombing that killed and injured a bunch of people, but maybe you can highlight what it is I'm missing that they have in common.

I'm not comparing them, I'm just saying that a martyr can die a death that isn't heroic.
Tsarnaev will become a martyr to others in his cause if we kill him. It will inspire copy cats. It's the same reason we never revealed where Osama's body was.
Massachusetts' death penalty law is irrelevant, as mentioned, and I'm sure federal prosecutors will be pushing for execution.

The other difference is Jesus was PUBLICLY executed. Tsarnaev will be inside of an execution chamber with a small audience if that. Not very martyr like if you ask me.
