It doesn't matter when the guy got the pictures, as long as they were both of legal age for each other (14 with 16, 15 with 15, 16 with 17, etc.) when it was sent, and as long as it came of the other person's own free will.

Here in the Swiss, you only need less than 3 years difference, and it's okay. Yes, a 7 year old and a 5 year old having sex is allowed. It will never happen though.
