They'll be fired instantly for joining a union and when you're so poor you need every dollar for every meal, you can't afford to go a few months without tips, without work, and they're the most replaceable group. Any attempts to unionize would lead to bad things.
There is too high of a demand for waiter and waitress jobs for them to unionize as abyss said, any hint of it happening and the restaurant manager would just immediate fire them and get new replacement staff within a week/ two weeks at most.
