I don't know how to word it, but as an overweight individual(albeit a law abiding one) I have this nagging feeling that this is going to bite me and other overweight people in the ass in time.

The thing is, there are numerous reasons somebody can be overweight, even morbidly obese. It's like looking at somebody who's vastly underweight and assuming it's because of their crippling heroin addiction. As much as people mock the whole 'glandular problem' thing, many overweight people actually [I]do[/I] have some kind of health issue which makes them gain weight, especially people who were perhaps out-of-shape before needing to be in a wheelchair or some other form of sedentary treatment for an extended period of time. It concerns me that people can lack sympathy for the overweight just because [I]one[/I] of the possibilities is a lack of self control.
Sounds like she deals with stress by overeating if she put on more weight after killing that man. I could see that being problematic in prison, but by no means is that an excuse.
It's alright. They'll just repurpose her as a cell.

Also a lot of people that consume massive amounts of alcohol tend to be very fat/obese too. Not that it isn't a problem, but they fit together.

He was raised too privileged to know better. He did NO jail time. This 'she's too overweight for prison' defense is tame compared to the shenanigans lawyers, on both sides, will do to win.

Using weight as a reason not to be sent to jail is the same thing as using age as a reason to not go to jail
