The typical way of ensuring a free and innovative society is to have any activity remain legal until there is evidence suggesting why it shouldn't be.
A lot of people seem to think that most people who are into lolicon are either into real kids too or exclusively like lolis.
I like lolis in a "A loli is fine too" sense but I don't like real kids at all, I find them gross. That's point one. Point two is that when I look at drawn porn I really don't care what age the character might be... If I find an image arousing, I save the image. In drawn porn any age difference is mostly head size, eye size, height and chest size. Which is just nitpicking, really.
Not to mention, lolis are often very different in body type from real children. The crushing majority of people who like lolicon don't find real children arousing. Where I'm trying to get is, comparing loli to CP is often unreasonable as reality is very different from stylized drawings so assuming the target audience for loli images are actual pedos is a mistake.

I feel like this banning of lolicon is the same argument that's used for violent video games. There's no real evidence that looking at loli porn will lead to actual child rape or molestation. If anything I'd assume having an outlet for those types of fantasies would be enough to satisfy people and perhaps prevent them from actually doing it in real life. That being said, that's just my assumption, so it doesn't really mean anything at all until there's real evidence. I don't think it's right to create laws like this just because people think it's "gross."
Also a funny thought I had. Does the quality of the picture matter? If I draw a half-assed stick figure with a dick and say he's 12, does that put my picture under scrutiny? Do you actually have to be a decent artist for the law to affect you? There just seems to be way too much of a grey area, I don't fully understand how this law can be fairly enforced...
