It's not illegal, per se, to pirate things. It's simply an infringement of copyright, and a violation of the agreement between you and your ISP. They'll sue you to hell, but you wont go to jail. Now, you may lose your Copyright. Copyright law states that you have to defend your copyright to maintain control of it, so if you just let people infringe on it willy-nilly they revoke it from you.

Copyrights do not have to be defended - you can selectively enforce your copyright without losing it. Trademarks, however, do have to be defended. If you do not actively pursue infringement, your trademark becomes diluted, and you can lose your trademark.
This is why Piracy is the highest in Australia this is money that could go into taxes and help Aus but oh well.
No wonder piracy is sky rocketing.

Torrent itself is not an illegal activity. It has a reputation of being used for committing copyright violation, due to it's decentralized nature, but the protocol itself is perfectly legal. If you are the rightful owner of the content you made (AKA developer of the game) and you give explicit permission to your userbase to download your content via Torrent and other protocols, then it is not piracy, and thus not an illegal activity. There is no law in place in any country that I know of that prohibits content owners to distribute their content via Torrent and protocols of similiar nature. There have even been artists that officially advertised and distributed their music via thepiratebay for free.

Like how Indigo Prophecy/Fahrenheit got banned because it had sex scenes it despite not being able to control them and the sex scenes being equal to an MA15+ film.
That funny, because it's prequel it's probably the game that made the biggest statement about violence in videogames in the recent years. You can, like, write an entire essay on 'Do you like hurting other people?' and how it breaks the 4th wall.
