There's a difference between a battle and a war crime. You do know that, right? And no, his guilt is not beside the point. If it was something he felt okay about doing, then it doesn't matter that he was ordered to do it, it's still his fault. He will indeed be dead soon, but it's about precedent not punishment.

Did you know that back then they killed any soldier who refused to do as they were told? Think about that for a second.

He won't be put in jail even if proven guilty, most likely.
And I do agree on the second part. I mean really, we put old nazis on trial, but when it's americans, it's 100% ok to kill "enemies". But hey, america is the king of earth, so it needs to bring justice.

If you don't obey the orders, you get killed instead. Many soldiers have families back home.

I wouldn't, but they are ordered to, and they do kill innocent civilians. i dont know if you heard about those soldiers killing people on the street then posing with the bodies... that happens too.

Point taken, but that was back then. In the present day you wouldn't get killed for not following orders.
According to most of Facepunch, if I were to murder 100 people and confess to it at the age of 95+, I should be completely immune to the legal system because they took so long to catch me.

The criminal justice system should be about rehabilitation and correction, not revenge. This is total bullshit.

If he's guilty then he's guilty. The question is more about how is putting the old man away going to improve society in some way?
The point of putting people in jail is to rehabilitate them to get back into society, or remove them from society if they're dangerous enough. he probably can't even wipe his own ass anymore, how is he a danger to society at this point?

If he was part of it, he was probably 30 years old, and seeing as how most soldiers during the holocaust were forced to kill those jewish people

I kind of agree with this, time does not wipe away the blood, but punishing a 97 year old man with 70 year old verbal evidence would be pointless. Altough the old guy shouldn't receive any kind of punishment I think a trial should be held to give the incident that happened 70 years ago a justified resting place.
