Technically speaking it's not discrimination in this case. Also in a lot of places with a dresscode similar things are in place.

Last I heard they moved away from the Gender and Sex disambiguation and instead are using primary and secondary gender. Or physical and social.
It also depends. In a lot of cases a judge would shoot it down on due to the spirit of ordnance as opposed to direct wording. Since in a case like this ferenda is probably stronger than lata.
