If you bankrupt BP, a lot of people (92,000 according to Wikipedia) will lose their jobs. You don't want 92,000 people jobless in this current economical situation. Whilst the people who failed to control the situation should be fired and fined, the rest of BP shouldn't be fined.

The Ixtoc oil spill was solved with just a relief well, which is what were trying to do today, but it's extremely hard to drill a new hole that deep underwater.
