Even if it was an air rifle he still would have died if he was shot at close range in the chest so it's hardly an excuse. Also it's a gun, personally I'd have checked if it was loaded before I fired the damn thing.

If he mentions loading the rifle, I call bullshit. There's definantly a difference between a .22 pellet and a .22 bullet. For starters, the bullet looks like a fucking bullet. Infact I'm pretty sure this is murder. You have to pump up an air rifle. If it's CO2 you still have to load it. He's old enough to know that bullets kill no matter the size, he isn't 8. In after ".22 kilsl wat do" The .22 is a very small bullet, but it's powerful enough to penetrate skin. A .22 is one of the most lethal rounds against an unarmored target, since it packs enough punch to puncture the skin but light enough to ricochet off bones. Meaning, if you get shot in the head, your brain gets turned into soup.

That said, a 5.56x45mm round (Most widely used round in the US military, in M16s, the M249, etc) is just about the same size in diameter as the tiny bullet you seem to think can't kill anyone.
