They "can't" do it but it still happens every day from traffic violations to drug possession, it is effectively at the officer's discretion to act or not, and nobody but the officer is the wiser

Doesn't matter if your selling kittens or weapons. I can look it from the perspective of the topic is irrelevant, which is what the law was intending to do. You can't sell in the area without a permit.
This is also hugely sensationalized, they were told to stop what they're doing, get a permit, and the parents realised at the end of the day it wasn't worth it. Everyone was polite, the officer and woman was understanding and nothing escalated. I'm sure the permit has a legitimate reason behind it, such as a health and safety check like hot dog stands.

Sure. When an officer of the law is granted administrative powers to arbitrarily decide whether or not to enforce a law, then the rule of law has been compromised. The only people allowed to exercise discretion in applying the law are judges, who are entrusted with this power due to their extensive knowledge and experience of the law.
