I'm not sure if you're aware of this, but generally when someone aims to attack you with a weapon, they have the fucking weapon out. Even in this kind of situation, I wouldn't think even for a second, even as a default position, that someone angry at me over an order at McDonalds is going to be carrying a lethal weapon.

That's sometimes what it takes to get someone to calm down in that state. When you are in a state like that everything else is drowned out, and all that you're focusing on is the threat in front of you. So when someone comes to break things up it calms things down.

The way I see it is this guy has a previous and somewhat serious offense, yet he is trying to live a normal life and reintergrate into society. Even if his response was overreacting the very most he should be mandated to have some councelling to help him deal with such stress issues, not penalized for being prevoked and so probably ruining any chance of a future job, condemning him to a criminal life style in order to surivive.

Well, they're humans, and they acknowledge the importance to condition human instinct and drive to survive. Since this guy was human I think it's fair to say human instinct and biology is what drives a fight or flight response.

And at the same time we're taught not to act on it, and think clearly before you act. To realize what you're doing while you're doing it. People that can't do that, that can't see that his reaction is over the top, are a hazard to society. They're people that can't see right from wrong. There are different levels of threats, you know. For example if someone comes at you with a gun, you're going to have a different reaction than someone yelling at you.

How can you differentiate between this being his survival instinct kicking in when faced with a threat, or a red mist descending on him and driving him into a serious assault on someone? people ignore those things all the time, so I don't think this guy should get a pass
