"Eye for an eye" comes originally from the Hebrew Bible but it was Hammurabi who made it famous. Before that people were killing each other just for petty theft and he wanted it to stop.
The concept of cutting someone's hands off for theft was a bastardization of [i]an eye for an eye[/i] and barbaric by today's standards but the intent is still quite clear. That being said, applying it literally creates an infinite loop. If you torture and kill someone who tortured and killed someone else, doesn't you also have to be tortured and killed? And so forth, forever?
